Regulations on Establishment, Maintenance and Recognition of Institutions:
(e) certificates issued by the NAAC, NBA, or NIRF for accreditation or ranking, as
the case may be;
(f) approval of the relevant statutory bodies according approval for conducting the
professional courses, which are currently being run in the institution;
(g) information regarding the existing academic and physical infrastructure;
(h) details of the financial sustainability of the proposed institution deemed to be
University along with the details of the corpus fund being created in the name of
the proposed institution deemed to be University;
(i) an undertaking to the effect that the proposed institution deemed to be University
shall abide by all the provisions of the Act, rules made under the said Act and
these regulations; and
(j) in the case of institutions that are fully or partially funded by the State or Central
Government, a letter of commitment from the respective Government to continue
financial support to the institution even after the declaration of the institution as
an institution deemed to be University.
(3) Copies of the documents referred to in sub-regulation (2) and uploaded on the
Commission’s web portal shall be disclosed on the website of the institution, duly
certified by the Head of the institution or sponsoring body, as the case may be, and if
any information is found to be false after due verification, the person responsible for its
uploading shall be liable for prosecution under the provisions of the Indian Penal Code,
1860 (45 of 1860).
(4) The Commission shall refer the application for examination by the Expert Committee
to be constituted by the Chairman of the Commission and the said Committee may
direct the applicant to make a presentation to demonstrate whether or not the institution
fulfills the requirements as specified in these regulations and the Committee shall
submit its report to the Commission, within thirty days from the date of reference to
it and on the basis of the said report, the Commission shall provide its advice to the
Central Government within sixty days from the date of receipt of the said report.
(5) Upon consideration of the advice of the Commission and examination of all aspects
of the matter, the Central Government, may within thirty days from the date of receipt
of the advice of the Commission, declare an institution of higher education as an
institution deemed to be University under section 3 of the Act, by notification in the
Official Gazette:
Provided that if the proposal for consideration and declaration as an institution deemed
to be University is not agreed upon, the Central Government shall convey its decision
in writing to the sponsoring body along with the reasons thereof and the decision of the
Central Government shall be final:
Provided further that an institution that was declared and notified for a limited period, as
an institution deemed to be University under section 3 of the Act, prior to the publication
of these regulations shall continue to be an institution deemed to be University in terms
of these regulations irrespective of the period for which the initial notification and
extension thereof, if any, was issued by the Central Government and in such cases, the
Central Government shall issue separate notification for continuation, on the advice of
Commission:
